Dudes, (and chicks), go pirate away! A Harvard law professor declared that P2P is fair use to a court. Now we’re talking.
After 6 years, some progresses are finally made in case of RIAA vs. Joel Tenenbaum (a file-swapper). Harvard law professor Charles Nesson tells the judge that copyright is total bullsh*t, and fair use FTW! Or if you want to be more precise, “that it doesn’t matter if Tenenbaum copied music; such noncommercial uses are presumptively “fair” and anyone seeking to squeeze file-swappers for statutory damages is entitled to precisely zero dollars.” (via Ars Technica)
I feel like that the RIAA should really considering look ahead a little bit. The tubes are going to take over everything. TV, music are all going to be available online for free in the near future; Hulu and Qtrax (which are both US only) are great examples of these, although Qtrax sort of failed. The Chinese (being one myself) had already enjoyed free music and TV for years now. The companies and artists that provided these free services are pretty successful in making money through other methods like ads, tours etc. So people in North America should be able to enjoy the same kind of treatment.
If this case is won by Nesson, this could mean that all free sharing of digital goods will be legalized. I doubt that will happen, but hey, I can still cross my fingers.
